Chapter 2 — China’s Social Credit System: A Pilot Project for the World

• An algorithm determines — whether or not a criminal will be granted bail, or whether or not they will receive parole.
• ProPublica Investigation 2016 — “Machine Bias” — COMPAS rated Black defendants as “high risk” at a rate twice that of White defendants — even when they possessed identical criminal records.
• Wisconsin Supreme Court case *State v. Loomis* (2016) — The use of COMPAS scores in sentencing was challenged — the court deemed the algorithm merely “one factor” to be considered — but did not ban it.

Europe:
• Estonia — “Robot Judge” — An AI judge has been delivering verdicts in minor cases (involving amounts under €7,000) — since 2019.
• Netherlands — SYRI System — Used AI to detect welfare fraud — automatically tagged impoverished neighborhoods as “high risk” — condemned by the UN Special Rapporteur — banned by a Dutch Court in 2021 on grounds of human rights violations.
